General Guest Waiver
HYBRID PERFORMANCE METHOD PLEASE NOTE: This waiver of Liability, Release, Acknowledgement of Risk, and Indemnification
Agreement (“Waiver Agreement”) is intended to be, and is, legally binding.
If any aspect of this Waiver Agreement requires clarification, have a HPM employee fully explain it before signing. By signing the HPM “Registration” you are agreeing to all terms set forth in this Waiver Agreement. You and/or the person on whose behalf you are signing, are waiving the right to bring any type of action, whether in court or otherwise, to recover compensation or obtain any other remedy for any personal injuries, damages to property, any accident or incident of any type, or death, arising out of or related to your use of HPM, its facilities, grounds, climbing walls, exercise areas, classes, equipment, whether the use is supervised or unsupervised. While HPM offers these activities in a controlled environment, there is still an assumed risk of injury to persons using HPM. In agreeing to this Waiver Agreement, I hereby acknowledge, understand, and agree on my behalf, and upon behalf of the person for whom I am signing, that the use of HPM, its facilities, equipment, climbing walls, classes and/or participating in activities sponsored by HPM have inherent risks. These risks include, but are not limited to, any injury of damage resulting from:
Negligence of employees, volunteer assistants, independent contractors of HPM. Negligent misuse of the facility, climbing walls, or equipment of HPM; falling off or impacting against the climbing walls, impact surface, floors, or anything else; rope abrasion, entanglement or other activities occurring on the premises; cuts or abrasions resulting from any cause whatsoever; failure of the climbing walls or equipment, whether inside or outside; personal health problems, whether mental or physical; negligence of other climbers, visitors, or observers or persons who may be present in or around the climbing area or facility; and/or negligence or lack of adequate training of any person(s) who seek to assist with medical or other help either before or after any injury or damage may occur.
HYBRID PERFORMANCE METHOD AGREEMENT AND RELEASE OF LIABILITY
- In consideration of being allowed to participate in the activities and programs of HPM and to use its facilities, equipment and machinery in addition to the payment of any fee or charge, I, for myself, my heirs and assigns, hereby waive, release, and forever discharge HPM, and their officers, agents, employees, representatives, executors and all others from any and all, responsibilities or liability from injuries or damages resulting from my participation in any activities or my use of equipment, classes, climbing walls or machinery in the above mentioned activities. I do hereby release all of those mentioned and any others acting upon their behalf from any responsibility or liability for any injury or damage to myself, including those caused by the negligent act or omission of any of those mentioned or others acting on their behalf or in any way arising out of or connected with my participation in any activities of HPM or the use of any equipment at HPM.
- I understand and am aware that, fitness, and climbing including the use of the equipment, are all potentially hazardous activities. I also understand that fitness activities involve a risk of injury or even death, and that I am voluntarily participating in these activities and using equipment and machinery with knowledge of the dangers involved. I hereby to expressly assume and accept any and all risks of injury or death.
- I do hereby declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent my participation or use of equipment, climbing wall or machinery except as herein stated. I acknowledge that I have either had a physical examination and been given my physician’s permission to participate, or that I have decided to participate, in the activity of, fitness, and climbing and the use of the equipment, climbing wall and machinery without the approval of my physician and do hereby assume all responsibility for my participation and activities, and utilization of equipment and machinery in my activities.

Door Lock:
If you purchased a 24hour guest pass, 7-day pass, 30 day guest pass or a full time membership you will be given a personal door code to be used any time you are accessing the facility:
After you have entered the code provided to you, wait for the white check mark to appear on the lock screen before opening the door. Sometimes the lock is slow and you can damage the door/lock by not waiting for the deadbolt to move. Make sure the door closes completely behind you so that the deadbolt can lock itself each time.
Leaving the facility:
- If you are the last to leave, please turn off all lights, fans. The lights and fan switches are located by the office door closest to the entry door. There are 4 switches and all of them can be turned off if you are the last person in the facility after your session You may leave the music on, but please turn it down to a reasonable volume.
Additional Guests:
- Guests are not allowed without booking a drop-in/guest pass first. Talk to the gym manager if you are unsure how to book a drop-in. Please never share your code with anyone or let anyone else in. This is a private club and we want to respect all member’s privacy and safety. The gym is monitored by high-def cameras. If you are bringing in other people without paying for a drop-in, you will be charged for each person you bring in. You may also forfeit your gym membership if this happens more than once.
Gym Etiquette:
- Please pay attention to all gym signage.
- Please always return weights to where you got them from. Do not leave weights on bars or machines.
- Please put bars back in racks or in holders.
- Do not leave bars, plates, clips, trash on floor. Please clean chalk off of bars using the brushes in the chalk bowls.
- Please keep chalk over chalk bowls at all times.
- Please respect the members that come after you by leaving the gym clean and organized.
Steel equipment:
- I will not use any steel plates, calibrated plates, or kettlebells on the any platform with a wooden inserts, or use steel plates with any of our Olympic Weightlifting Bars.
Filming:
- Filming is allowed. Please try to avoid walking through other people’s filming area.
- While training in HPM's facility I agree to media ( photos and videos) that I am in to be used in HPM media for advertising marketing products and services.
Music:
- Music (if none is playing): Join the Wi-Fi. Share your music from your device to “Living Room”. That will share to the Sonos speaker. Please do not change music that is already playing without asking others if doing so is ok.
Animals/Dogs:
- Member and guest dogs are NOT allowed in the facility.
- If you bring an animal that is not approved by the gym manager before you arrive for your visit you will be asked to leave and/or return without the animal.
- A member or guest choosing to ignore the animal policy will be financially responsible for any damage to the facility and equipment cause by said animal, and forfeit their access without promise of a refund without warning.
